This Article signifies the importance of the deceased and their burial rights due to the flustered outbreak of COVID-19 in India with recent facts. It is proclaimed under the Indian Constitution that "All are equal before the eyes of law" whether they are alive or dead. So right to have a dignified burial implies to people even demised from a highly infectious disease. However, Article 21 of the Indian Constitution depicts “No person shall be deprived of his life or personal liberty" and in the case of deceased they are obliged to have a dignified burial. Thereupon everyone has the right to protect the deceased with no interferences. If there is any entrenchment of the rights of the deceased or if anyone outrages the human corpse may be punished under the provisions of IPC and every State has the obligation to protect the burial rights of the deceased inclined under Article 21 of the Indian Constitution. Which signifies the disposal of a dead body with a dignified cremation or burial in accordance with the religious faith the man pledged .
